Video recordings have become a regular part of our lives. We capture everything on video. Our kid's first steps, the birth of our children, and even the day we got married are all caught on camera. At the same time, technology has advanced to the point where we can now create realistic video images of people long deceased—an ability that can cause issues in areas like estate law.

The Rule Against Perpetuities

In estate law, a concept is known as "the rule against perpetuities" prevents future generations from being bound by conditions in a will that aren't likely to be fulfilled until a distant future date. The rule was created because older wills sometimes required heirs to fulfill impossible tasks or wait a very long time before they could claim their inheritance.

This rule has been interpreted to cover situations where someone's last will and testament are made invalid by a more recent testament, like when someone updates their will on their deathbed. While this may seem straightforward, courts have also had to address cases where an additional testament is not made by the testator (the person who wrote the will) directly but by someone else who was present during their final moments or who heard them make verbal statements while they were dying.

A will is a legal document to state your final wishes about who should be in charge of your life's remaining details after you're gone. This can include information about how you want your funeral service to be handled, how you want to manage your finances and other assets, who you would like to be the guardian of any minor children, and so on. However, a will only sometimes provides all the information needed to carry out these instructions.
