It depends. You can make a will without any property papers, but it is not recommended. A will allows you to distribute your assets in the way you want after your death, whereas a property document is used to ensure that a person who inherits any property takes care of the legal and administrative aspects of owning the said property.

If there is no valid will or property papers, all of your assets will be distributed according to a predetermined fixed order. Your spouse or partner may inherit your assets if you do not have minor children and if there are no other surviving relatives who would get priority over them.

A living trust is different from a will in that it is a type of trust established while you are still alive which allows you to bypass probate when you die. If there are no property documents and if the deceased did not leave behind a living trust, then all of their assets will go through probate, which means that the court will have to sort out their legal affairs in order for their assets to be distributed.

There are a few other things that you'll need to be able to do in order to make a will—you'll need to decide who should get your assets and possessions after you pass away. But whether or not you have everything together at this point doesn't mean that you can't make a will.
